Energy Act Policy Implementation: Mark Barolo (OUST)
This session will include of a general overview of the EPA guidelines and address some of the common questions received on the Energy Act topics, including State Fund Soundness, State Fund Diversion and State Fund Solvency, as well as an opportunity to address questions from the audience.

Reducing Expenditures From State Funds Through the Use of Cost Control Tools
Robert Hodges (SC) and Stuart Gray (EPA Region I), Facilitators
This session will examine three common tools used to reduce expenditures from the state cleanup fund: Equipment Re-use, Source Removal, and Subrogation. In a roundtable format, panel members will give short, 5-10 minute talks about how their state uses the particular highlighted tool and the factors related to its success. Facilitators will then moderate discussion among those in attendance about what tools work and don’t work in their state and why. Facilitators will be recording obstacles, innovative ideas and experiences of what worked and what did not and this information will be shared electronically with the group following the meeting.

Remediation 101

Are you a CPA, lawyer, administrator or new to your program? Do you often look at claims or hear conversations among staff and furrow your brow over such acronyms as MPX, AS and SVE or wonder what in the heck is a Veeder Root? Don’t be afraid any longer, this session will provide an introduction and overview of UST system components and the basic contamination assessment and remediation processes, as well as information on where to find additional resources from EPA OUST and state programs.

Reducing Expenditures From State Funds Through the Use of Program Processes
Robert Hodges (SC) and Stuart Gray (EPA Region I), Facilitators
This session follows a format similar to the 1:30 pm Cost Control Tools session but will discuss 3 program processes that can be implemented to reduce the costs of cleanup: Pay for Performance, Pre-Approval, and Streamlining. The processes will be presented by a short talk on each subject followed by discussions. Facilitators will be recording the key elements of the discussions to present to the attendees following the meeting.

Records Retention and Electronic Document Management

Paper, paper everywhere…. Can I turn it into bytes? This session will be a round table discussion in which several states share information about their experiences implementing and using electronic document management systems. Attendees who are still struggling in a sea of paper will get useful information on how to move into the electronic age, and those who are already using document imaging and storage systems will pick up tips from others for improving their systems. The session will include a discussion of policies and schedules for record retention.

Claim Payment Workshop
Carol Eighmey (MO) and Mona Wunder (NE), Facilitators
“Do you pay for...?” How many times has someone asked you that question? If you process claims or manage a tank fund, you have undoubtedly asked or answered that question hundreds of times! Participants in this workshop will be given an actual claim – one with some unique characteristics! -- and will work with others at their table to review the claim and decide what to pay and what not to pay. Each table will then orally report to the whole group how much they agreed to pay and why. Come prepared for lively dialogue and a fun learning experience, during which we will see how our state funds are alike – or different – in what we do or do not pay for!

The Role of State Funds in Preventing Releases

This session will be a round table discussion in which participants will discuss ways in which state funds can be used to prevent future releases and promote better business practices. It will also explore the obstacles that inhibit state funds from being used in this manner as well as the means in which to overcome those obstacles. Potential topics include challenges to implementing prevention measures, inspections, operator training, energy act tie-in, and non-compliance impacts on eligibility and deductibles.

Fund Soundness Workshop, Part 1
William Foskett (OUST) and Robin Hughes (OUST), Facilitators
This session will use an interactive case study approach to consider which ways might work best to restore the financial soundness of a state fund. Each group will present a plan and projected results and hold an open discussion of opportunities and obstacles to avoid financial deficiency. This workshop will provide an opportunity to capitalize on the experience of each other and identify practical remedies for financial deficiencies.

Impacts of Alternative Fuels on State Funds, Part 1
James Pearson, (MN) and Kara Sergeant (NEIWPCC), Facilitators
In this session representatives from states, EPA, and industry will briefly describe their experiences with alternative fuels from a technical and policy standpoint. Facilitators will then solicit input from other states to share their experiences on alternative fuels and lead a discussion on the impacts on state funds.

Fund Soundness Workshop, Part 2 (Williams / Demmens)
William Foskett (OUST) and Robin Hughes (OUST), Facilitators
This session will use an interactive case study approach to consider which ways might work best to restore the financial soundness of a state fund. Each group will present a plan and projected results and hold an open discussion of opportunities and obstacles to avoid financial deficiency. State fund managers have used as many as 27 approaches to “repair” their funds by either making more money available or cutting cleanup costs. This workshop will provide an opportunity to capitalize on the experience of each other and identify practical remedies for financial deficiencies.

This session will include presentations from Wisconsin and Florida regarding their efforts to improve the effectiveness of state funded cleanups and/or address constraints associated with completion of the state funded cleanup site workload. In addition, a representative from EPA-OUST will present information on their 2006 Cleanup Backlog survey of the State UST petroleum cleanup programs.

State Fund Programs for Abandoned Tanks

Representatives from several states will briefly describe their state fund programs designed to address abandoned tanks, including how their programs work, the keys to success and the challenges they faced. The majority of the time will be devoted to discussion of what other states are doing, their successes and challenges and how they compare to the presenters' states. Ideas for improving state fund abandoned tanks programs will also be discussed. Please come prepared to discuss what is and can be done to deal with abandoned tanks.

In this round table session representatives from attending states are encouraged to share a brief description of specific approaches to improving the effectiveness of state-funded cleanups and/or addressing constraints associated with completion of the state funded cleanup site workload that have been used in their state, and to identify factors affecting their success (i.e. lessons learned).
